AVERUM LEGAL successfully defended the interests of the agricultural company STRUBE UKRAINE GMBH, part of Strube International, in an administrative dispute challenging the actions and decisions of the State Tax Service of Ukraine regarding the blocking of tax invoices issued by the client to its counterparty.
AVERUM LEGAL’s lawyers thoroughly analysed the primary documentation that confirmed the business transactions between the client and the counterparty. They also carried out a pre-trial challenge against the regulatory authority’s decisions, which provided a strong foundation for substantiating the client’s claims in court.
Special attention was given to an in-depth analysis of tax legislation, which served as the legal basis for the court appeal and a study of case law and the European Court of Human Rights decisions.
Due to the professional handling of the administrative case, the Sixth Administrative Court of Appeal fully accepted the client’s arguments. It rendered a favourable decision: declared unlawful and cancelled the regulatory authority’s decisions to suspend the registration of tax invoices, amounting to approximately $540,000, and ordered the State Tax Service of Ukraine to register the tax invoices in the Unified Register.
